Fundamental issue in Ayodhya case -Subrahmanya Swamy

The fact remains that throughout the last several centuries, Hindus have deeply held as sacred as Ram's birthplace that exact spot where the Babri Masjid once stood.

This is recorded in UK & India courts since 1885 in many official and judicial proceedings.

1. In 1885, for example, Mahant Raghubar Das, in a Suit No. 61/280 of 1885 filed in the Court of the Faizabad Sub Judge against the Secretary of State for India (who was based in London), prayed for permission to build a temple inside the perimeter of the mosque. His suit was dismissed on March 18, 1886, but in his Order the Sub-Judge, an Englishman, stated: “It is most unfortunate that a Masjid should have been built on land specially held sacred by the Hindus. But as the event occurred 358 years ago, it is too late now to remedy the grievance.”
2. Since the British as policy never sought to disturb the communal and social status quo in India as evidenced, for example, on the ‘Sati question,' the judge took the easy way out and dismissed the suit.
3. A masjid is not an essential part of Islam religion, according to a majority judgment of a Constitution Bench of India's Supreme Court (op.cit. 1994)
4. According to the House of Lords, U.K. (1991), the temple is always a temple even if in disuse or ruins.
5. “The correct position may be summarised thus. Under Mohammedan law applicable in India, title to a mosque can be lost by adverse possession. A mosque is not an essential part of the practice of the religion of Islam and namaz (prayer) can be offered anywhere, even in the open. Accordingly, its acquisition is not prohibited by the provisions in the Constitution of India”(para 82).
6. Otherwise any government can deprive Muslims of the Babri Masjid, which would be lawful if the government decides to do so in the interest of public order, public health and morality (Article 25 of the Constitution).
7. This is the position in Islamic law as well since in Saudi Arabia the authorities demolish mosques to lay roads. Even the mosque where Prophet Mohammed used to pray was demolished.
8. No such ruling anywhere in any court exists for a mosque for the simple reason that a mosque in Islam is just a facilitation centre for reading namaz, and has no essentiality for Islam as a religion.
9. Governament can therefore be demolished and/or shifted in India under the Constitution as any building can — but of course authorisedly for a public purpose such as public health, public order or morality. The Union Government is committed by virtue of its affidavit filed in the Supreme Court in 1994 to do so if it is found that a temple structure exists below the mosque site. It must hence perform now and deliver on its commitment on oath sworn in the Supreme Court.
10. What was wrong with the demolition of the Babri Masjid on December 6, 1992 was that it was unauthorised by law and a criminal offence.

15 prominent leaders brokered deal

They said they had been working quietly for four days and a deal was struck around midnight on Tuesday. Though the efforts to arrive at a compromise began on Saturday, they gained momentum only after the arrival of Shoaib’s brother-in-law, Mr Imran Zafar, on Tuesday evening.

Community leader Mr Imran Qadri said there was “too much ugliness in the past two months, which has been affecting both the countries.

It’s true that there was a nikah, whether through telephone or anything else, and he needs to agree to the divorce if he wants to marry Sania. He agreed and signed the divorce papers that were sent to Dr Shams Babar’s residence,” said Mr Ahmadullah.

A Hyderabad-based rationalist faces an arrest warrant from a Kangeyam court in western Tamil Nadu for allegedly going back on his promise of Rs 5-crore reward to a vaastu consultant there for proving that vaastu is effective and scientific.

When the case comes up on Thursday (April 8), the vaastu expert, Mr M. Palanisamy, hopes to see the police get Mr T. V. Rao of the Vaasthu Nija Nirtharana Vedika Committee of Hyderabad to the court for going back on his promise of reward made before the media in Coimbatore five years ago.

Mr Rao says that the reward was not announced by his Vedika but only by a US-based rationalist-non believer group, ‘James Randi Educational Foun-dation’, as could be seen on its website.

On the JREF site, www.randi.org, founder James Randi had promised long ago a reward of a million dollars “to anyone who can demonstrate any psychic, supernatural or paranormal ability under satisfactory observing conditions”. The site also warns that several applicants “have suffered great personal embarrassment after failing these tests.”

“Rao is speaking of this American organisation only now after I staked a claim for the reward. I have been fighting my case for a long time and only when he started dodging my calls and failed to respond to my vaastu papers that I had sent, did I move the court for justice,” the expert said.

1. In 2002 launched a consultancy engineering firm, Backops Services Private Limited
2. an M.Phil degree in Development Studies from Cambridge University
3. A stint as financial consultant in London
4. holding 83 per cent shares in it. A close family friend and aide Manoj Muttu, one of the two Directors of the company
5. As per his affidavit to the Election Commission of India during the 2004 elections, he held 83 per cent shares in Backops Services in which he had made a capital investment of Rs 2.5 lakh.
6. He had 100 shares of Intel,
7. 52 shares of Palm
8. 10 shares of Ericsson.
9. The main objective of Backops Services was to provide, among other things, back-office and advisory support service to international and domestic clients across different industry segments, to carry on business as programmer, developer, consultant and advisor in the field of IT, and to provide market and product services, web solutions and set up web sites for e-commerce activities.
   
10. The company had an authorised share capital of Rs 25 lakh divided into 25,000 equity shares of Rs 100 each. Gandhi was the largest shareholder with 2,500 shares while Muttu held 250 shares.
    Anil Thakur, son of Madhya Pradesh Governor Rameshwar Thakur, held 150 shares and another Delhi resident, Ranvir Sinha, had 100 shares. Both Thakur and Sinha resigned as Directors of the company in March 2006 due to "personal reasons". Gandhi and Muttu remained the only two Directors.
